These Terms of Sale govern your purchase of products from Romark Industries, Inc. ("Romark," "we," "us") through romarkindustries.com or directly from us, and your use of this website. They apply to all Romark products, including our aerial bucket hooks, handline hooks, blanket hooks, trigger-lock hooks, crew packs, and HookBoss™ concrete float hooks. By placing an order, you agree to them.

The short version

Romark hooks are tool and equipment hooks: for holding tools, hand lines, insulating blankets, and similar equipment. They are not life-safety, fall-protection, climbing, rigging, or lifting devices.
Romark hooks are backed by our 3-year no-break guarantee, and all products carry a limited warranty against defects in materials and workmanship.
Our liability is limited to the amount you paid for the product.
Ohio law governs these terms.

1. Who you're buying from

Products sold on romarkindustries.com are sold by Romark Industries, Inc., an Ohio corporation located at 20545 Center Ridge Rd., Suite 205, Rocky River, OH 44116. HookBoss™ is a Romark Industries brand.

2. Orders and acceptance

Your order is an offer to buy. We accept it when we ship the product. We may refuse, limit, or cancel any order, including for suspected fraud, pricing or description errors, product unavailability, or quantities that appear to be for resale where we haven't agreed to distributor or wholesale terms. If we cancel an order you've already paid for, we'll refund it in full.

3. Pricing, taxes, and errors

Prices are in U.S. dollars and may change at any time before you place an order. Applicable sales tax is calculated at checkout. While we work to keep the site accurate, typographical, pricing, and product-description errors happen; we reserve the right to correct them and to cancel any affected order, even after it's been submitted.

4. Payment

Payment is processed by our third-party payment processor. By submitting payment information, you represent that you're authorized to use the payment method and you authorize us to charge the full order amount, including tax. See our Privacy Policy for how payment information is handled.

5. Shipping, title, and risk of loss

Shipping terms, timing, and free-shipping eligibility are described in our Shipping Policy. Title and risk of loss pass to you when we deliver the product to the carrier. Delivery dates are estimates, not guarantees, and we're not liable for carrier delays.

6. Returns and exchanges

Returns and exchanges are governed by our Returns & Exchanges policy. In summary: product must be new, unused, and in its original box; returns ship prepaid; we reimburse return shipping only if we shipped the wrong part or the product is defective; and the buyer covers replacement freight on exchanges.

7. Product use and safety

Romark products are designed to hold tools and equipment, such as hand tools, hand lines, rubber insulating blankets, and concrete floats, on a belt, aerial bucket, rail, handle, or similar mounting point, as described for each product. They are not personal protective equipment. They are not designed, tested, rated, or sold for:

fall protection, climbing, or supporting or arresting a person;
lifting, hoisting, rigging, towing, or overhead load-bearing;
use as electrical insulating protective equipment, or in place of the rated insulating gear, cover-up, or PPE your work requires;
any life-safety application; or
any use outside the product's intended purpose and posted specifications.

You are responsible for selecting the right product for the job, inspecting it before each use, using it appropriately for the task, and following all applicable jobsite safety rules, OSHA requirements, and employer policies. Do not modify, cut, drill, heat, or alter the product.

8. Limited warranty and no-break guarantee

No-break guarantee. Romark hooks molded from Fortelene™ are backed by a 3-year no-break guarantee. If one of these hooks breaks under normal use in its intended application within three years of the date of purchase, we will replace it.

Limited warranty. Romark also warrants that its products, including HookBoss™ products, are free from defects in materials and workmanship under normal use in their intended application. If a product is defective, your exclusive remedy is, at our option, replacement of the product or a refund of the purchase price.

How to make a claim. Contact us at [email protected] or (440) 333-5480 with your order number or proof of purchase and a photo of the product. We may ask you to return the product for inspection.

The guarantee and warranty do not cover normal wear, cosmetic marks, loss, or damage resulting from misuse, abuse, modification, alteration, improper installation, use outside the intended application, or use in any of the applications excluded in Section 7.

9. Disclaimer of other warranties

Except for the guarantee and limited warranty in Section 8, and to the fullest extent permitted by law, the products and this website are provided "as is," and Romark disclaims all other warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so this may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, Romark's total liability arising out of or related to any product or these terms will not exceed the amount you paid for the product at issue. Romark will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost time, project delays, or damage to tools, equipment, vehicles, or work in place, even if we've been advised of the possibility. Some states do not allow certain limitations, so parts of this may not apply to you.

11. Trademarks and content

Fortelene™, HookBoss™, Lineman Tough™, the Romark logo, product images, copy, and other site content are the property of Romark Industries, Inc. and are protected by trademark and copyright law. You may not copy, reproduce, or use them without our written permission. Other manufacturers' names and part numbers mentioned on our site (for example, Klein and Buzzline) belong to their respective owners, are used only to identify compatible or comparable products, and do not imply any affiliation or endorsement.

12. Use of this website

You agree not to use this site for any unlawful purpose, to interfere with its operation or security, or to scrape, harvest, or copy its content for commercial use. We may suspend access for misuse.

13. Wholesale and distributor purchases

Wholesale, distributor, and bulk purchases may be governed by separate written terms, pricing, credit, case-quantity, and freight arrangements. Distributor pricing is available to qualified buyers; see our For Distributors page. Where those separate terms conflict with these, the separate written agreement controls.

14. Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Cuyahoga County, Ohio, and you consent to their jurisdiction.

15. Changes to these terms

We may update these terms at any time. The version in effect when you place your order applies to that order. The "Last updated" date at the top of this page shows when these terms were last revised.
